
On 21 October Ilham Aliyev signed a decree "On the application of the principle of "single window" when issuing foreign grants at the territory of Azerbaijan. According to the decree, this order will come into force from January 1, 2017. Coordinating public authority in respect of commercial entities is appointed the Ministry of Economy, in the religious structures - the State Committee for Work with Religious Organizations, in relation to other non-profit organizations and individuals - the Ministry of Justice.
The Cabinet of Ministers is to simplify the procedure for an opinion on the financial and economic viability in the issuance of a grant, ensure its issue on the appeal of the foreign donor and the recipient. The Government is in charge to prepare proposals for the implementation of this Decree within two months.
Commenting on the decree the expert in the field of law Alasgar Mammadli noted that the document "basically does not change anything in the current situation." Firstly, is preserved the previous procedure for registration of grants by three government departments, and there is the principle, not a "single window" and "three windows".
Secondly, there remains the procedure of issuing conclusions on the financial and economic feasibility grants. Still the government decides if any grant will be implemented or not.
The findings will give the Ministry of Finance in accordance with previously adopted principles of rendering foreign donor assistance. Among these priorities are not the issues of human rights, democracy and the fight against corruption. The human rights aspect of the topic is limited to solving problems of internally displaced persons, projects in the field of culture, social services, etc.
Thus, said Mammadli, the decree does not improve the legal environment for civil society. To create favorable conditions for the work of civil society is necessary, first of all, to change the law, to cancel reactionary amendments of the past years. -06D-
