ECHR recognized violation of Natig Jafarli’s rights
Baku / 07.11.19 / Turan: The European Court of Human Rights today announced a decision on the complaint of the Executive Secretary of the REAL party, Natig Jafarli.
The ECHR has ordered the Azerbaijani government to pay Jafarli compensation for moral damages and reimbursement of legal expenses totaling 17 thousand euros.
It is noteworthy that the ECHR found a violation of Jafarli’s rights, among others, also under the Article 18 (Limits of use of restrictions on rights), which means confirmation of persecution for political reasons.
In general, the Strasbourg court very rarely applies this Article.
According to it, the ECHR admitted violation of the rights of the leader of REAL Ilgar Mammadov, human rights activists Rasul Jafarov, Intigam Aliyev, Anar Mammadli and several activists of the NİDA movement and several other people from the post-Soviet space.
In addition, the ECHR found violations of Jafarli's rights under Article 3 (prohibition of torture), 5 (right to liberty and security of person) and 11 (right to association) of the European Convention.
Jafarli’s complaint was related to the initiation of a criminal case against him in 2014, repeated interrogations, and the arrest in August 2016 on charges of illegal business and abuse of power.
Although Jafarli was released a month later, but within a year he could not leave the borders of Baku in connection with a non-departure subscription.
Only in August 2017 did the prosecutor general's office close the case.
Jafarli himself is satisfied with the decision of the ECHR, and in particular, the recognition of his arrest for political reasons.
He noted that in total, the ECHR adopted 10 decisions on Azerbaijan and four of them concern REAL activists.
In his opinion, the ECHR’s confirmation of the political persecution of the opposition is a serious message to the authorities on the need to fight with opponents in the language of force and arrests. –16D-

In 2024, the ECHR made 39 rulings regarding Azerbaijan. In 38 of these, at least one violation of the European Convention on Human Rights was found. Only in one case were no violations identified. These statistics were presented at a press conference by the head of the ECHR at the end of 2024, the legal information website aihmaz.org reported.

On February 4, the ECHR announced two rulings regarding complaints filed by these applicants, as reported by the legal information website aihmaz.org. The applicants contested the violation of their property rights during the demolition of their homes for the construction of the "Winter Park" in central Baku, as well as the failure to provide fair compensation. They also requested that the Strasbourg court recognize violations of their rights to a fair trial, respect for private life, effective legal remedies, the right to submit an individual complaint, and other related rights.
