The journalist will seek justice in the European Court
The Baku Appeal Court presided over by judge Jamal Ramazanov rejected the complaint of the correspondent of radio station "Voice of America" Tapdig Farhadoglu.
The appeal was filed against the decision of the Yasamal District Court which dismissed the appeal against the Yasamal prosecutor's office investigator, Mubariz Asadov, who refused to file a lawsuit on the beating of a journalist. Farhadoglu does not agree with the decisions of local courts and intends to file a complaint with the European Court of Human Rights.
Today, the journalist’s lawyer, Samir Agayev, was not allowed to participate in the consideration of the appeal. This was motivated by the innovations in the Criminal Procedure Code, according to which at the trial of criminal cases victims can protected only by lawyers. A legal representatives can now only protect witnesses. Thus, at the trial Farhadoglu was unprotected.
On February 20, 2014 , the Head of Security Service of Baku State University (BSU), Mahir Hojjatov, hit the journalist with his fist and kicked in the back and on the head when Farhadoglu was shooting the protest by students. As a result, the journalist lost partly lost his working ability.
The video shows how Hojjatov was beating the journalist. In fact, it is a crime under the Article 163 of the Criminal Code (interference with the lawful activities of a journalist.)
"Despite the existence of video evidence, the court dismissed the complaint, and I will appeal to the European Court," said Tapdig Farhadoglu.
The journalist appealed to President Ilham Aliyev, the Attorney General, the Joint Working Group on Human Rights to objectively investigate his case. -04В-
