It is prohibited to transfer the taxpayer's personal identification number (TIN) and electronic signature to other persons
Baku/04.08.23/Turan: The State Tax Service, operating under the Ministry of Economy, has issued a stern advisory to citizens of the country regarding the establishment of legal entities. The organization urged individuals not to form such entities without genuine entrepreneurial intentions.
According to the State Tax Service, individuals who provide the Constituent documents, Taxpayer Identification Number (TIN), and electronic signature of enterprises established in their name to other individuals create an environment conducive to criminal activities related to tax evasion schemes. In such cases, those individuals will be held accountable for the future tax obligations arising from these entities.
The warning comes after the Main Department of primary investigation of tax crimes of the State Tax Service conducted investigations into certain criminal cases. It was found that some directors, founders, or individual entrepreneurs of enterprises, who were not actively engaged in business activities, had their electronic signatures (especially ASAN imza) handed over to other individuals. Subsequently, these individuals deceived citizens by assuring them that they would not be held responsible for certain financial commitments or transactions. With the help of the acquired electronic signatures, they carried out various financial transactions for a short period of time, ultimately evading the taxes applicable to such transactions. -0-
