Transport Ministry to Purchase Land for Public Use
The Ministry of Transport defined authority, contracting for public use land in private and municipal property, as well as state-owned lands for the use and lease rights, subject to the construction of road infrastructure. Resolution of this with the number 83 took the Cabinet of Ministers on May 24.
Cabinet instructed the Ministry of Transport Tim same document to carry out preparatory work for the purchase of land for public use in compliance with the requirements of the Law of Azerbaijan Republic "On the purchase of land for public purposes" and to submit proposals to him about it.
Earlier, similar powers were received by the state-run Azersu and Meliorasiya ve Su Teserrufaty,according to their functions.
The Ministry of Transport does not always cope with the function of the payment of compensation for the expropriation of land for public use. For example, at present the Administrative Economic Court number 2 in Baku continuing litigation over non-payment of compensation by Baki Elvan Metal for alienation of public land used by them and demolished properties in the project to build a highway in the Buzovna settlement of Baku. 08D
