Ali Insanov Wants to Sue Head of Supreme Court
Located in prison, the former Minister, Ali Insanov, sent the head of the Supreme Court, Ramiz Rzayev, a request in connection with the failure to execute the European Court decisions regarding Insanov.
The European Court of Human Rights on March 14, 2013, granted the petition from Insanov on the right to fair trial and confirmed that he was tortured.
For this reason, the European Court ruled that the government of Azerbaijan has to pay Insanov a compensation of 10 thousand euros.
Recall that Insanov was arrested in October 2005, and charged with preparing a coup. Later his charge was changed and he was sentenced to 11 years for economic crimes.
In April 2007, the former Minister’s property was confiscated.
According to the lawyer Togrul Babayev, who talked to Turan, the decision of the European Court entered into force on 14 June this year. By law, the European Court's decision must be implemented no later than three months after being received by the Supreme Court. The Chairman of the Supreme Court has to present the case to one of the judges and bring it to the plenum.
However, until now, Ali Insanov has not been provided any official information about making the case for the Supreme Court plenum, although the decision of European Court was delivered to the Supreme Court on July 10 of this year.
"Ali Insanov considers that the actions of the Supreme Court are part of the usual policies pursued against him for 9 years. The aim is to extend the stay of Insanov in prison," said the lawyer.
Insanov called the head of the Supreme Court, Ramiz Rzayev, not to delay the implementation of the European Court's decision. Otherwise, he intends to file a lawsuit against Rzayev and appeal to the Committee of Ministers of the Council of Europe.
In turn, the Secretariat of the Supreme Court told Turan that the Plenum of the Court has not yet received the decision of the European Court on the Insanov case. -03B04-
