Court Overturns Decision on Claim of Ministry of Taxes to Turan News Agency for AZN 38,000
Baku / 19.12.17 / Turan: The judge of the Baku Administrative Economic Court No. 1 Sharafat Mammadova canceled the decision of the Baku Local Taxes Department on December 19 to re-charge the debt and fines in the amount of 38,000 manats to the Turan agency on September 15 of this year.
It should be reminded that on November 8, the Ministry of Taxes sent a notification to the Turan news agency about the complete withdrawal of claims for tax evasion and fines for more than 38,000 manats. The Agency demanded to present a decision on the withdrawal of claims, but the Ministry refused to present it, noting that this is not necessary.
The Agency sued. Three hearings were held, and each time the judge suggested that the Ministry of Taxes present the decision. Finally, today, she decided to cancel the re-accrual of debt on September 15. The director of the Agency Mehman Aliyev expressed satisfaction with this decision.
As you know, the Baku City Tax Department on August 7 accused the Agency of tax evasion exceeding AZN 27,000 in 2014 - 2016. Together with the fines, the total amount was more than 38,000 manats. A criminal case was launched against the Agency.
On August 24, the Agency"s director, Mehman Aliyev, was arrested. On September 11, he was released on his own recognizance not to leave the city of Baku. On the same day, the Ministry of Taxes canceled its decision on charges of evading taxes and charging AZN 38,000.
The criminal case was terminated by the Ministry of Taxes on October 30 and approved by the Prosecutor General's Office on November 2.
It should be noted that the Agency has not yet received a resolution to terminate the criminal case, despite the November 6 appeal to the Prosecutor General"s Office. -0----

On January 13, the trial in the case of public activist Nijat Ibrahim continued in the Baku Serious Crimes Court under the chairmanship of Judge Aygun Gurbanova. The International Committee of Concerned Scholars (ICS) has appealed to the President of Azerbaijan, Ilham Aliyev, requesting his assistance in securing the release of the arrested researcher, Igbal Abilov. The ICS expressed concern that Abilov's arrest "may be related to his research on ethnic minorities in Azerbaijan, conducted in collaboration with scholars from Armenia."
