European Court Starts Communication on Death of Prisoner in Baku

Baku / 06.27.17 / Turan: The European Court of Human Rights started communication in the case of the death of a convict Elshad Babayev in Prison No. 14 in December 2014. According to his relatives, Babayev died of torture.

The ECHR sent questions to the Azerbaijani government: Babayev's rights guaranteed by articles 2 (the right to life), 3 (prohibition of torture) and 13 (the right to efficient legal defense) of the European Convention were violated. The lawyer Fariz Namazli wrote on his Facebook page about that.

Upon the death of Elshad Babayev, criminal proceedings were initiated under articles 309.2 (abuse of authority with the use of violence, which entailed grave consequences).

The results of the investigation did not satisfy Babayev's family and they appealed to the ECHR.

The sister of the late Simuzar Babayeva distributed a photo of her brother's body, on which numerous bruises and scars on his head were visible. She stated that the photo was taken from a forensic building. However, the examination concluded that Babayev died of a heart attack.

The interests of the applicant are represented by the lawyers Khalid Baghirov, Samed Rahimli, Ruslan Aliyev and Ramute Remezaite.

As Samed Rahimli explained to Turan, the complainant in the case is the sister of the late Simuzar Babayeva.

Rahimli noted that the complaint raised the issue of direct responsibility of the state for the prisoner"s death, and the ineffective investigation into Babayev's death.

"Elshad Babayev was beaten by the prison employees, and in a grave condition he was imprisoned in a punishment cell and no medical assistance was given to him. However, no one was prosecuted for this. The prosecutor's office started a criminal case and then the proceedings were terminated. Complaints in the order of judicial supervision were in vain, and so an appeal was sent to the ECHR," Rahimli explained.

According to him, the government should answer the ECHR"s questions within three months. -03B06-
