Increase of fines and duties is for the benefit of citizens - Chingiz Asgarov
Baku/25.06.21/Turan: Deputy Chairman of the Supreme Court of Azerbaijan, Chingiz Asgarov, spoke in support of legislative amendments to increase state duties in court proceedings.
“It may seem that the bill is intended to facilitate the work of the courts and increase their income, however, first of all, it is aimed at protecting the rights of citizens,” Asgarov said on Friday during the discussion of the amendments in parliament.
According to him, the parties often do not present any evidence to the Supreme Court during cassation appeals. The measures taken are aimed at eliminating this. In addition, often one of the parties does not come to court, thereby delaying the proceedings.
According to Askerov, "the courts are not interested in raising duties." “Currently, only 2% of these fees are sent to the courts. Although all the sums should be given to them. On the other hand, the law on state fees exempts low-income people from paying fees," Asgarov, said, calling the criticism of innovations "unfounded".
As for the imposition of fines, this measure applies not only to the parties to the trial, but also to the administrative authorities that do not submit documents.
“This is a fine for filing a petition without a clear justification. The petition is filed not by a citizen, but by a lawyer who wants to artificially prolong the trial,” Asgarov said. —16D-
