The ECHR found Armenia responsible for the crimes of the military in Karabakh
Baku/18.10.23/Turan: On October 18, the European Court of Human Rights announced a ruling on the case "Oganesyan and Karapetyan v. Armenia".
Mikael Oganisyan and Svetlana Oganesyan, whose sons R. Oganisyan and A. Sargsyan were killed while serving in Karabakh, were the applicants in this case.https://hudoc.echr.coe.int/eng#{%22itemid%22:[%22001-228148%22]} Both soldiers were drafted into the army from Armenia in 2009 and 2008 and sent to serve in a military unit located in the "NKR" (quoted in the ECHR ruling – ed.).
On July 28, 2010, at about 18:00, R. Oganesyan, A. Sargsyan and four other servicemen were found dead with gunshot wounds. According to the applicants, their children were victims of irregular relationships, were tortured, beaten and killed. The Armenian authorities did not conduct an effective investigation to identify and punish all the perpetrators, including higher-ranking commanders, the applicants believe.
The ECHR recognized violations of the applicants' rights under Article 2 (right to life) The European Convention on Human Rights and Freedoms. The Strasbourg Court decided to pay each applicant 30 thousand euros as compensation.
Azerbaijani lawyer, member of the Presidium of the Bar Association Mukhtar Mustafayev considers this decision of the ECHR very important from the point of view of another confirmation of the fact of the occupation of Azerbaijani territories by Armenia by an international court.
In an interview with a Turan correspondent, he drew attention to the fact that the ECHR decision confirms that Armenia sends its citizens to the army service in the occupied territory of Azerbaijan.
In addition, the ECHR recognizes Armenia responsible for crimes committed on the internationally recognized territory of Azerbaijan.
The ECHR ruling also refers to another decision of the Strasbourg Court in the case "Chiragov and Others v. Armenia", in which Armenia was found responsible for the expulsion from their homes and the deprivation of property of a group of persons from the Lachin region, the expert noted.
"The ECHR's decision in itself is a response to those who accuse Azerbaijan of restoring sovereignty over its territories," Mustafayev said. ---06B---
