The European Court settled four claims against Azerbaijan
Baku/22.07.21/Turan: The European Court of Human Rights (ECHR) today, on July 22, announced its decisions on four cases from Azerbaijan. The Strasbourg court committed the Azerbaijani authorities to pay compensation worth 51,200 euros.
It should be noted that one of the decisions concerns cases of two journalists.
The ECHR revealed in the case of Rovshan Makhmudov and Yashar Aghazade, editor-in-chief of the newspaper "Mukhalifat" and former contributor of the newspaper "Mukhalifet", that applicants' right to freedom of expression was violated. According to the decision, the Government must pay the applicants a total of 2,400 euros to compensate for moral damage and 1,000 euros to reimbuirse expenses.
The claim was related to criminal prosecution for an article allegedly "discrediting" late Acad.Jalal Aliyev (uncle of Azerbaijani President Ilham Aliyev) titled "AMAI is the Aliyevs 'trade brand".
After a claim from Jalal Aliyev, the journalists were found guilty of libel by the Yasamal district court on May 16, 2007, and each of them was sentenced to two years and six months of imprisonment.
In December 2007, the journalists were pardoned by the President of Azerbaijan.
It has to be noted that the ECHR has previously ruled on the claims of Agazade and Makhmudov for harassment under another article about Jalal Aliyev.
Another decision is related to the claim of a journalist, director of the newspaper "Azadlig" Azer Akhmedov. The ECHR found a violation of the right to protection of private life. The government must pay Azer Akhmedov 4,500 euros to compensation for moral damage and 2,500 euros to reimburse court costs.
Note that the case is due to wiretapping Akhmedov's telephone conversations with his colleague Agyl Khalil.
Also, the ECHR revealed a violation of the rights of applicants in the case "Kerimov and others v. Azerbaijan" - Vahid Kerimov, Mahir Abbasov and Mubariz Bayramov under Article 6 (right to a fair trial) of the Convention.
The court committed the government to pay compensation of 3,600 euros to each applicant. The case concerned the detention of the applicants for non-payment of debts.
One more decision is connected with the claim of the citizen of Armenia Badalyan against Azerbaijan. The ECHR ruled that the applicant's right to freedom and security and the prohibition against torture had been violated. So, 30,000 euros have to be paid to the applicant.
This case is related to the applicant's capture on the Azerbaijani-Armenian border and his detention in Azerbaijan for 22 months. -D06-
