Entry and exit restrictions must be determined by the court
Baku/12.03.21/Turan: "Who can restrict entry and exit to the country?" This was the topic of the next release of the "Difficult Question" program of the Turan agency, which aired on March 12. The guest of the program, lawyer Samed Rahimli, commented on some aspects of the annual report presented to parliament by Ombudsman Sabina Aliyeva.
The lawyer expressed his position on the prohibition of entry and exit of citizens from the country, the activities of the institute of the Bar.
Samed Rahimli agreed with the ombudsman's proposal that a court may impose a ban on citizens from leaving the country.
"It's a good offer. If it is accepted, then the citizen will know at least in advance that he cannot leave the country. The fact that the citizen does not even suspect that they have problems and will find out about them already at the border checkpoint. If the proposal of the Ombudsman is accepted, the citizens will know about the travel ban in advance and will not suffer material losses,” Rahimli said.
Concerning the activities of the institute of the Bar, the Ombudsman proposes to remove some obstacles in this area. The lawyer believes that there is no need to claim three years of experience as a lawyer for candidates for lawyers. This qualification must be abolished, or lowered to 1 year.
Rahimli opposes having an oral interview in addition to a test exam on admission to the Bar. In his opinion, a test is enough. At the same time, he is against admitting lawyers who have worked in the civil service for 7 years based on only an oral examination.
In his opinion, in this way the authorities want to eliminate the lack of lawyers and at the same time involve dependent people in the collegium.
The lawyer believes that in fact they want to eliminate the shortage of lawyers in this way and, therefore, to attract dependent people to the collegium.
This does not increase the professionalism of the legal profession, but, on the contrary, harms it.
According to Rahimli, in order to improve the professionalism of the defense institution, it is necessary to restore the institution of representation, which was abolished several years ago. -05D-
