Relatives of martyr can go to court - expert
Baku/30.04.21/Turan: Disrespect for the memory of the martyr deserves condemnation; however, lynching for this is unacceptable, said legal expert, lawyer Asabali Mustafayev in an interview with Turan's "Difficult Question" program in the April 30 issue.
The other day, the user of social networks Fuad Rasulzade spoke unethically about the martyr Khudayar Yusifzade, who, thanks to the performance of folk songs at the front, gained great popularity among the population.
Mustafayev believes that unauthorized "punishment" for expressing himself on social networks can become a dangerous precedent that will provoke a wave of violence. He noted that the legislation of Azerbaijan does not provide for a punishment for insulting a martyr or any historical person. However, there is Article of the Criminal Code 148 (insult), which allows it to be applied in such cases. The lynching will call into question the legal nature of the state, the rule of law. Mustafayev believes that law enforcement agencies should have taken urgent measures to prevent violence.
The expert believes that the martyr's family should have gone to court immediately. However, even now, they can do it, said the lawyer. According to him, any controversial issue should be resolved in the courts.
Fuad Rasulzade, who made an ironic statement about the martyr Yusifzade, was beaten by the brother and two cousins of the martyr Yusifzade. In fact, the police filed a lawsuit under the Article "Hooliganism", no detainees. — 06D--
