Capital Bank earns from "denomination" payments for non-citizens of Azerbaijan

The heirs of Telman Ramizov will miss at Kapital Bank 378 AZN 46 kopecks for a lump-sum payment of deposits in the Savings Bank of the USSR. The reason is that one of his daughters (Sanubar Tour) married in Turkey and is a citizen of this country.

The late Ramizov on March 1, 1991 deposited in the Soviet Sberbank 12,708 manats, which is converted to the equivalent prescribed by the Decree of the President, and is AZN 1,135.40. In family housing office the Ramizovs were given a certificate that at the time of his death, Telman's housing was resided by three - his wife (Shafiga Ramizova), son (Farhad Ramizov) and the said daughter. The protests of the other children - heirs of Ramizov at the time of his death and living at other locations were not responded by Notary's Office Number One or any housing office.

The law-abiding citizens on the advice of the authorities collected the documents (birth certificate, marriage certificate, power of attorney to receive the money, and other information) referred to the relatives. In the department Sabail 2 (Icherisheher) Capital Bank they were told the amount due will be divided into three parts, two of the country's citizens will receive a lump sum payment, and the citizen of Turkey is to open an account, and AZN 378 plus will be denominated twice (first to share 5 thousand pieces, and then another 10.) So if Sanubar Tour arrives in Baku, she can get 7 cents. The notarized power of attorney from her mother has not helped her.

Turan correspondent asked for clarification from the Bank (a leading expert Hikmet Behbudov) and a special commission under the Ministry of Finance to review disputes between authorized banks and investors (or their heirs) of the former USSR Savings Bank (Samir Nasibov, the chief advisor of the legal department of the Ministry of Finance). Both sources with reference to the Presidential Decree of 14 March 2012 reported that the heirs, who are not citizens of Azerbaijan, are deprived of the right to a lump sum payment, and they have to open a special account with the subsequent denominations.

When asked where evaporates almost absolute difference between the solid (as in this case) share of the heir and the denominated pennies, there was no response and they just added that so the decree states. But careful and repeated reading of the document did not find anything like this, and there is nothing in the FAQ posted on the websites of the bank.

Today abroad reside tens of thousands of depositors of the Savings Bank and their heirs who are not citizens of Azerbaijan. If each of them opens an account and the owed money is "denominated" (it does not evaporate), you can imagine the extent of violations of citizens' rights and benefits of Capital Bank through housing offices and notary offices.

And more - according to the presidential decree, one-time personal payments are not indexed as personal savings deposits. The legal acts of the former Soviet Union and the laws of the Azerbaijan Republic do not establish liability for the obligations of the State Savings Bank of the USSR.

It turns out that the current payments are additional assistance provided by the state to citizens of Azerbaijan due to the devaluation of their savings, and this is made possible by increasing the financial capacity of the state.
