Entry into Force of Anti-dumping Law
The law of Azerbaijan Republic "On anti-dumping, countervailing and safeguard measures" has entered into force. According to the Ministry of Economy, the goal is the protection of domestic producers from subsidized exports to the country, and dumping (goods imported into the country at a price below the cost).
Recall that on July 13 President of Azerbaijan signed the decree. The law provides various measures to help identify evidence of dumping, including an increase in the size of the customs duty on the import of products in the amount of the dumping margin, which is within the principles and norms of the World Trade Organization.
According to the law, in the absence of similar products in the domestic turnover of the exporting country, or if the volume of sales of these products in the domestic market is less than 5% of the volume of its exports, the margin will be determined by comparing the export price of products with the export price for these products in a third country.
Effect of the dumped or subsidized imports on local production will be determined by the analysis of imports, its impact on the value of local products, the difference between the price of imported and local goods, the margin of dumping, and a number of other indicators.
In this case the anti-dumping measures can be applied only after careful research and 60 days after the beginning of the test, and the temporary duty rate cannot be higher than the margin of dumping and amount of subsidy. The term of temporary anti-dumping measures will be from 4 to 9 months, depending on the applications of exporters, and temporary compensation measures - not more than 4 months. In general, the anti-dumping and countervailing measures cannot be used for more than five years.
In the preparation of the draft law by the Milli Majlis four WTO directives were used. --17D-
