Fines will be charged for lack of insurance against industrial accidents

The Parliament of Azerbaijan provides fines for legal persons for the absence of the policy on compulsory insurance of disability of individuals from accidents and occupational diseases.

According to the information on the website of the Milli Majlis, innovation envisaged in the draft amendments to the Administrative Violations Code was developed by the parliamentary committee on social issues. The penalty will be 5 thousand manats. Administrative sanctions will be also exposed to officers (1.5 thsd manat from each careless head of office) and even individuals (500 manat).

According to the Head of State Insurance Supervision Service of the Ministry of Finance Namik Khalilov, in Azerbaijan there is 4.7 million of working-age population. All in all, on the basis of the State Social Protection Fund (SSPF) there are 2.58 million personal account holders paying for compulsory insurance. That is, about half of the workers have not entered in the register, and employers, mainly small and medium-sized private enterprises, evade compulsory payments. This, in turn, leads to gaps in the compulsory insurance.

The project will be discussed during the autumn session of Parliament.

The law "On mandatory insurance of disability of individuals from accidents and occupational diseases in production" was approved in July 2010. In December 2010, the process of approval of regulations for the start of services on this type of insurance was completed.

The Cabinet of Ministers in November 2010 approved the tariffs for compulsory insurance against disability resulting from accidents in production. According to this decision, all economic activities are divided into 14 levels of risk. Based on this level of risk, determined the amount of the insurance rate for employees and workers at the plant, which is 0.2 % to 2%, depending on the risk level of the enterprise.

The Ministry of Finance receives annual funding of AZN 10 million for the effectiveness of the law, which is returned to the budget untouched.

According to the law the insurance rate is estimated to payroll at the company. The law provides for three types of insurance payments: monthly, one-time and extra. - 17D-
