Purchase of land for water supply
The Cabinet of Ministers adopted on 11 December decision on imposing authority of Azersu to speak on behalf of the government in the procurement of land for the reconstruction of water supply and sewage systems in Baku as well as 40 cities and regions . In many of these areas (Shamakhi, Gabala, Agdash, Goychay, Ganja, etc.) thy are already working on the construction and reconstruction of water supply and sanitation.
The government has charged Azersu in this area to carry out the preparatory work for the purchase of land in these cities and areas for public use in accordance with the law "On the purchase of land for public use," and submitted to the Government in connection with this proposal.
This is the first public statement on the web page of the Cabinet decision on the facts of land acquisition for the implementation of government projects after the entry into force in May 2010 of the act. However over the past year and a half in the country there were implemented dozens of projects of various sizes, which were followed by the acquisition of the citizens and other owners of land and real estate.
Under this law, if there is the need to acquire land from the owners, the Cabinet shall take appropriate action, and only then can begin negotiating with the owners for the alienation of property. In fact, in many cases, the land is taken away from the owner and after court decisions some of them manage to get some compensation. Litigation in these cases continues to this day.
It is noteworthy that Azersu in 2007-2009 selected land plots from 3 thousand landowners. Some of them were planted with perennials. However, according to human rights organizations, about 90% of them have not received fair compensation under the legislation. - 08B-
