Azerbaijani government is obliged to pay 28 thousand euros to seven applicants to the ECHR
Baku/11.02.21/Turan: Today the European Court of Human Rights announced two decisions on complaints from Azerbaijan. The applicants in the case of “Nijat Panahov and others v. Azerbaijan” in addition to the said person, were also Shalala Atamova, Mehpara Jafarova and Lala Yusifova.
As members of the Jehovah's Witnesses religious community, they complained about police interference, violation of their rights to liberty and security of person, freedom of assembly, and freedom of religion.
During the communication, the Azerbaijani government sent a unilateral declaration of recognition of the violation of rights and readiness to pay compensation to each applicant in the amount of 4 thousand euros - a total of 16 thousand euros. Despite the fact that the applicants did not agree with the government's declaration, the ECHR excluded the case from consideration and ordered that the government should pay 4 thousand euros to each applicant.
In the second case, “Sadullah Genj and others v. Azerbaijan”, the applicants were the said person and two other Turkish citizens, Tughrul Kyraz and Saim Samur.
These Muslim believers have complained of violations of their rights to liberty and security, fair trial and religious freedom.
Thus, in April 2012, they were detained during a religious meeting in Ganja and fined 2,000 manats.
The Azerbaijani government has recognized the violation of the rights of these applicants and expressed its readiness to pay them compensation for 4 thousand euros. The ECHR agreed with the government's proposal and ruled that 4 thousand euros were paid to the applicants.
In case of failure to fulfill its obligations, the ECHR may return to the consideration of cases. — 05В03 / 06-
