Baku / 25.09.20 / Turan: The European Court of Human Rights announced a decision in the case of Elmin Badalov and Anar Aliyev. The issue was removed from the consideration of the ECHR in view of reaching an amicable agreement between the Azerbaijani government and the applicants.

The complaint was made in connection with the incident on 28 July 2010. Elmin Badalov, then a correspondent for the “Yeni Musavat” newspaper, and Anar Aliyev, the deputy editor of the Milli Yol newspaper, were attacked in the village of Mardakan when they were preparing a report on the luxurious mansions of the oligarchs.

The journalists were attacked by the guards of the mansions, who severely beat them. After that, they were dragged into the territory of one of the villas, where the beating continued. At the same time, Badalov's editorial chamber was taken away and smashed. Journalists claimed that the incident took place at the villa of the then Minister of Transport, Ziya Mammadov.

The journalists' complaints to law enforcement agencies were not satisfied. The applicants in their appeal to the ECHR asked to recognize the violation of their rights under Art. 3 (prohibition of torture), 10 (freedom of expression) and 13 (right to an effective remedy) of the European Convention on Human Rights.

The Azerbaijani government offered the applicants peace, recognizing the violation of their rights, and agreeing to pay compensation for 8 thousand euros to each. The applicants accepted the offer and in view of this, the ECHR withdrew the case. — 06D-
