Incident with Downed Russian Helicopter Shall Be Investigated in Azerbaijan
Baku / 06.01.20 / Turan: The incident with the Russian military helicopter downed on the Nakhchivan section of the Armenian-Azerbaijani border on November 9 last year should be investigated by the investigative authorities of Azerbaijan. This opinion was expressed by an expert in law, Alasgar Mammadli, commenting on the re-classification of the criminal case on this fact by the Russian military prosecutor's office.
According to Interfax, Russian military investigators replaced Article 351 (violation of flight rules, resulting in the death of a person through negligence) by Article 105.2 (premeditated murder of two or more persons) of the Criminal Code of the Russian Federation.
The agency's source pointed to difficulties in the investigation, "since the suspects in the case are on the territory of another state." Therefore, Russian military investigators turned to their Azerbaijani counterparts for help.
According to Mammadli, only the prosecutor's office of Azerbaijan can investigate this case. “The prosecutor’s office should investigate the case only within the framework of Azerbaijani legislation. The incident was committed by the Azerbaijani military while serving on their territory. Azerbaijan’s sovereign rights operate on the territory of Azerbaijan,” Mammadli said.
The lawyer noted that if at the end of the investigation there are guilty ones, they can only be tried by the court of Azerbaijan.
On the eve, the press secretary of the Prosecutor General's Office of Azerbaijan, Gunay Salimzadeh, told Turan that Baku had not received any official request from the official bodies of the Russian Federation in this case.
The military prosecutor's office of Nakhchivan opened a criminal case on November 10 last year under Article 342.2 (negligence in service, resulting in the death of two or more people through negligence, or during a war or military action).
