Police Violate Candidate Immunity Law
Baku / 12.02.20 / Turan: The day before, during the dispersal of a peaceful protest rally, a group of candidates for deputies were detained before the CEC: Rabiya Mammadova, Irada Javadova, Farhad Mehdiyev, Turgut Gambar, and Elman Guliyev.
Observers believe that the police, having detained candidates for deputies, violated the law, namely, the rule of the Electoral Code on the integrity of candidates.
Thus, according to Article 70.1 of the Electoral Code, a candidate has immunity until the official publication of election results. He cannot be detained, subjected to administrative punishment, appointed by the court. He can only be detained red-handed while committing a crime. In this case, the prosecutor or the court must immediately notify the district election commission about this. —06D-
