Prosecutor General's Office Sends M. Huseynov's Appeal to CEC
Baku / 07.02.20 / Turan: The Azerbaijani Prosecutor General’s Office in connection with the appeal of a candidate for deputy in the 31st Surakhani second district by blogger Mehman Huseynov about trying to bribe him by the election candidate Faraj Guliyev appealed to the CEC to make an appropriate decision.
This was announced by the head of the press service of the Prosecutor General’s Office, Eldar Sultanov.
“Appeal to the Prosecutor General’s Office of a candidate for deputy in the 31st Surakhani second electoral district Mehman Huseynov about an alleged violation of the requirements of the electoral law by Faraj Guliyev registered in the same district in accordance with Art. 112 and 112.1 of the Electoral Code was sent for consideration and appropriate decision to the CEC and he (Mehman Huseynov) was officially informed about this,” Sultanov wrote on his Facebook page.
Note that Art. 112 and 112.1 of the EC give a candidate the right to appeal against actions that violate his voting rights.
In this case, a link to these articles does not reveal the essence of the issue. Therefore, the statement of Sultanov does not clarify what legal consequences may result from the appeal of the Prosecutor General to the CEC.
Huseynov himself told Turan that he did not receive any official notification from the Prosecutor General’s Office about the direction of his appeal to the CEC.
Huseynov refrained from commenting on Sultanov’s statement, noting that he should consult with his lawyer.
A meeting of the CEC is scheduled for February 7 at 4 p.m.
On February 5, the CEC decided to issue a warning to Faraj Guliyev.
At the same time, the head of the CEC, Mazahir Panahov, said that "this is not a final decision." According to him, the Prosecutor’s Office is also investigating the incident, and the final decision will be made taking into account the results of the Prosecutor’s investigation.
Recall that Guliyev offered Huseynov 15,000 manat to withdraw his candidacy from the parliamentary elections on February 9th.
Independent lawyers unequivocally stated that Guliyev’s acts contained a corpus delicti and his candidacy should be eliminated. -06D-
