Rauf Mirkadirov is not allowed to have Turkish lawyers
Baku/29.05.14/Turan : Investigative authority did not permit the arrested journalist Rauf Mirkadirov issue a proxy for hiring a lawyer in Turkey to protect his rights. The relevant appeal was sent 10 days ago to the investigator of the General Prosecutor Ibrahim Lemberansky, but the answer was negative , said the lawyer Elmar Suleymanov.
Defence believes that the arrest and extradition of Rauf Mirkadirov by Turkish authorities to Azerbaijan on April 19 was not a deportation, but extradition.
By refusing to grant a power of attorney to Turkish lawyers the investigation has violated Mirkadirov’s rights guaranteed by the Constitution of Azerbaijan and the European Convention on Human Rights; the fundamental right to file a judicial complaint was also violated.
The lawyer considers that if the Turkish court recognizes the violation of Mirkadirov’s rights when issuing him to the Azerbaijani authorities , it would mean a violation of his rights from the very beginning of this process. This increases the prospects of winning the case in the European Court of Human Rights. According to Suleymanov, therefore the investigation prevents Mirkadirov’s attempts to start litigation in Turkey.
According to Suleymanov , Turkish lawyers want to defend the rights of Mirkadirov, but this requires issuing the power of attorney. A complaint was made to the Nasimi District Court against the refusal to allow the investigator Mirkadirov to give power of attorney, the lawyer said. -16D-

The European Court of Human Rights (ECHR) today issued five rulings on applications from Azerbaijan. The case of "Afgan Mammadov v. Azerbaijan" concerned the complainant's exclusion from the Bar Association. Mammadov was expelled based on a complaint filed by a colleague, which he considered unjust. The ECHR ruled that Mammadov's rights had been violated and ordered Azerbaijan to pay him €5,000 in compensation for moral damage and €1,000 to cover legal costs.
