Shahin Aliyev: The Law Cannot Liquidate the President's Administration
Baku / 26.04.17 / Turan: "The law cannot liquidate the Presidential Administration, because its creation is stipulated in Article 109 of the Constitution." AzerTaj was informed about this by the Head of the Legislation and Legal Expertise Department of the Presidential Administration Shahin Aliyev, who commented on the amendments to the Law on State Service, introduced by the Parliament on April 25.
According to him, the essence of the changes to the law "On the civil service" is that a number of structures providing the activities of the President were included in the classification of civil servants.
"For example, in addition to the Presidential Administration, the Presidential Affairs Office and the President's Special Medical Service take part in the operation of the President. For this reason, in the proposed changes to the law "On State Activities", the structures ensuring the activities of the President are listed in the plural. The name of the Presidential Administration can be reflected in the law, since this name is in the Constitution. However, the names of the two other structures I mentioned - the Presidential Affairs Office and the President’s Special Medical Service cannot be included in the law, because in that case, the powers of the President of the Republic of Azerbaijan could be limited," Shahin Aliyev said.
Shahin Aliyev stressed that according to the Constitution, the President cannot violate the laws.
"If the existence of the structures I have mentioned was reflected in the law, in the future, if necessary, the President could not re-create or change the name," Shahin Aliyev said. -0-
