The ECHR announced decisions on five cases from Azerbaijan
Baku/20.07.23/Turan: On July 20, the European Court of Human Rights (ECHR) announced 5 decisions that were made on the basis of unilateral statements by the government and the achievement of amicable agreements between the parties.
In the case of "Azad Hasanov and Abulfaz Sadigov v. Azerbaijan", the applicants complained of unjustified criminal prosecution because they were members of the opposition Musavat party. They asked the ECHR to recognize the violation of their rights under Article 5 (right to freedom and personal integrity) of the European Convention on Human Rights and Freedoms. In view of the Government's recognition of the violation of the applicants' rights, their complaints are excluded from the list of cases considered by the Strasbourg Court. At the same time, the Government undertook to pay each applicant 3,500 euros for compensation for moral damage and court costs.
In another case, "Ramin Ahmadli and Others against Azerbaijan", the parties reached a settlement agreement.
The applicants Ramin Ahmedli, Bashir Tarverdiyev, Nurlan Gahramanli and Khanov Musayev complained of violation of their rights under Articles 6 (right to a fair trial) and 11 (freedom of association and assembly) of the European Convention, and in particular on "illegal" and "disproportionate interference" during protest actions.
According to the terms of the settlement agreement, the government agreed to pay Akhmedli, Tarverdiyev and Gahramanli as compensation for 2,850 euros and another 3,900 euros to Musayev.
In a similar case, oppositionists Abdullah Mahmudov, Ramid Nagiyev, Orkhan Salamzade, Emil Salamov, Aydin Isayev and Vahid Maharramov will receive 2,850 euros as compensation as a result of the settlement agreement.
In the case "Imran Aliyev v. Azerbaijan", the applicant complained about the unlawful restriction of his freedom of movement, and in particular the introduction of a ban on leaving the country.
The parties have reached a settlement agreement and now Aliyev will receive 1,500 euros as compensation.
In the case of Fidan Rustamova v. Azerbaijan, the applicant complained about unfair court proceedings against her in connection with unpaid debts and the introduction of a ban on her leaving the country. The parties reached a settlement agreement, according to which Rustamova should be lifted the ban on leaving the country and 6,000 euros should be paid as compensation. ----06B----
