Baku/20.11.21/Turan: On November 19, the European Court of Human Rights (ECHR) adopted the third decision on interim measures against former Prosecutor General and former Azerbaijani Ambassador to Serbia Eldar Hasanov to comply with Rule 39 of the Court Rules due to his health condition. His lawyer Javad Javadov told Turan about it.

According to him, in May and June the ECHR already adopted a decision after which Hasanov was transferred to the State Security Service hospital, albeit with a long delay.

In October, a Ministry of Health commission came to the conclusion that although Hasanov suffers from vertigo, hypertension, diabetes and other diseases, but there is no need for inpatient treatment.

"And this is despite the fact that Eldar Hasanov periodically falls down even during court sessions and is taken out of the court on a stretcher. We submitted to the ECHR the opinion of doctors from Turkey which said that a patient with such serious illnesses should receive qualified medical care in an inpatient setting. Even the commission of the Ministry of Health, although noting the lack of the need for hospitalization, stressed the need for physiotherapy procedures and physical exercises. However, there are no conditions of this sort in the pre-trial detention center," said the lawyer.

According to him, the ECHR has taken into account the arguments of the defense, demanding from the government to ensure all necessary measures and provide Eldar Hasanov with adequate, highly qualified medical care, including in-patient facilities.

In addition, the ECHR obliged the government to regularly inform the government about the medical care provided to Hasanov during his detention.

The lawyer also pointed to the bias of the judicial investigation, the rejection of defense motions and the holding of sessions despite Hasanov's poor state of health.

"There is no reliable evidence against Eldar Hasanov. His signature is not under any document," said the lawyer.

Hasanov himself said in court on November 19 that despite his bad health conditions, one of the officials imposed a ban on providing him with specialized medical care. He did not name the official.
Also, he added that he did not expect a fair verdict, yet, he was sure that sooner or later he would be acquitted.

*Eldar Hasanov was detained on August 13, 2020, by the state security service officers. He was charged under five Articles: 179.3.2 (embezzlement), 193-1.3.2 (legalization of illegally obtained funds), 308.2 (abuse of office), 308-1.1 (misuse of budgetary funds) and 313 (official forgery) of the Criminal Code.

Hasanov is charged with embezzlement and misappropriation while serving as Azerbaijan's Ambassador to Romania, Serbia, Bosnia and Herzegovina and Montenegro from 2010 to 2020.  -06B-
