The Supreme Court did not satisfy Turan�s complaint
Baku / 07.03.18 / Turan: On March 7, the Supreme Court under the chairmanship of Sevda Huseynova held a trial on the cassation appeal of Turan Information Agency. The complaint was filed against the decision of the Baku Court of Appeal, which in its turn upheld the decision of Administrative-Economic Court No. 1 about the groundlessness of the information agency's claim.
Note that in September last year Turan filed two lawsuits against the Ministry of Taxes, which asked the court to declare illegal the appointment of the Department of Investigation of tax crimes of a tax audit in respect of the agency, and also to recognize as unfounded and unlawful three decisions of two departments of the Ministry on the calculation of taxes.
Decisions were taken in August 2017. Subsequently, these two lawsuits were merged into one, and the court refused to satisfy them.
Fuad Agayev, the lawyer of the agency, made a statement at the meeting, which stated that groundless tax inspections were stopped in 1996 by the order of former President Heydar Aliyev: "This decision was made because of numerous complaints about the actions of employees of tax authorities.
In the same year, with respect to the agency Turan was appointed a tax audit aimed at making it out of order. However, then the results of this audit were canceled. Last year there was a similar situation. We filed a lawsuit with the Administrative Economic Court regarding the illegality of tax inspections. However, the court ruled that the claim for such inspections can not be filed, since the tax audit did not entail grave consequences.
However, the Ministry of Taxes itself indicates that such complaints can be filed. This is also reflected in the verification forms. What more serious consequences can there be if the head of the agency Mehman Aliyev, being innocent, was arrested and spent about three weeks in jail?
Only after the unanimous decision of the Small Chamber of the US Senate to take sanctions against all persons involved in the illegal arrest of Aliyev, he was released.
In parallel, the agency's activities were paralyzed, and it was forced to declare its closure. The agency's activity was restored a few months later," the lawyer said.
Immediately after these words, the judge Huseynova, interrupting her lawyer, recalled that at the moment they are not considering aspects of the criminal case, but civil suit. After that, lawyer Agayev added: "If the courts violate the order of Heydar Aliyev, what can we talk about? I ask to satisfy the cassation appeal ".
The representative of the Ministry of Taxes limited himself to one sentence, in which he asked the court not to satisfy the complaint. Having conferred on the spot for 3 minutes, the judicial board ruled that the cassation appeal of the agency was not satisfied.
Lawyer F.Agayev, commenting on Turan's decision, said that he was saddened by the court decision, but not surprised: "The court's decision is illegal," he added. -0--
