In a recent statement released by the Azerbaijan National Statehood Party, the party vehemently denies any association with a purported announcement circulating on internet news sites regarding the termination of its activities. The party asserts that the statement in question, issued by individuals claiming to represent the party's Political Council, is entirely false and lacks any legal basis.
The National Statehood Party is quick to clarify that the Political Council does not possess the authority to make decisions of such magnitude, specifically regarding the dissolution of the party. Citing legal provisions, the statement underscores that the power to terminate a political party lies exclusively with the party congress or the court, as outlined in both the law on political parties and the Civil Code of the Republic of Azerbaijan.
Paragraph 9.1 of the law on political parties explicitly states that a party may only be liquidated based on the decision of the party congress or the court, in accordance with the provisions of the law and the Civil Code. The National Statehood Party further points to its own charter, specifically referencing Article 5.9, which outlines the circumstances under which the party's activities can be suspended – a decision that requires a two-thirds majority vote of the congress representatives or as stipulated by the legislation of Azerbaijan.
The party emphasizes that no congress took place in the last year, and thus, no decision was made to suspend its activities. Consequently, the statement circulating online declaring the termination of the party is dismissed as entirely false and lacking any legal grounding.
The National Statehood Party of Azerbaijan unequivocally asserts that it continues its political activities without any interruption. This denial serves as a clarification to dispel misinformation and maintain transparency regarding the party's organizational structure and decision-making processes.
