Complaint against the arrest of activist R. Huseynzade rejected
Baku / 01.02.19 / Turan: The Baku Court of Appeal today considered a complaint about the arrest of a young activist Rafael Huseynzade, who was detained on January 25 in a single action demanding the release of political prisoners.
The young man was arrested for 30 days, found guilty under Article 535.1 (not subordinating to the lawful demands of a police representative) of the Administrative Offenses Code.
Consideration of the complaint about the arrest of Huseynzade was held at the Baku Court of Appeal on February 1 under the chair of Judge Kamran Akperov.
Rafael Huseynzade said in court that he was arrested on libelous charges, and he did not show any obedience to the police, but merely conducted a peaceful protest.
Lawyer Javad Javadov also pointed out that the arrest was groundless.
He drew attention to the fact that the rally by Huseynzade and his detention were captured on video frames that are distributed on the Internet.
The record shows that the young man does not offer any resistance or disobedience.
The court of first instance arrested him solely on the basis of allegations by the police themselves.
In addition, Article 535.1 imputed to an activist provides for alternative penalties not related to arrest.
However, the court ultimately rejected the complaint and left the activist in custody.
The relatives of the activist stated that the young man was arrested for freedom of expression, and they will appeal to the European Court of Human Rights.
Father of Huseynzade, activist of the Popular Front Party Fizuli Huseynov also is known for holding pickets demanding the release of political prisoners. He also was detained and arrested for this. -06D--
