Court Does Not Satisfy Complaint of Elina Hajiyeva�s Family
Baku / 19.07.19 / Turan: The Baku Court of Appeal today did not satisfy the complaint of the family of the 8th grader of school number 162, Elina Hajiyeva, who had committed suicide, against the decision to extend the house arrest of the director of this institution, Sevinj Abbasova.
The family of the deceased insists on imprisoning the director of the school.
Judge Gabil Mammadov dismissed the complaint on the grounds that the defense did not meet within three days of appeal after the decision of the court of first instance.
In turn, lawyers for the family Sevinj Aliyeva and Emin Isayev told journalists after the court session that the decision of the Sabail District Court to extend the house arrest of the school principal for another two months was made on July 9 without the knowledge of the defense representatives. The lawyers learned about the decision only on July 13th.
Now they will appeal to the Sabail District Court to restore the time limits for filing an appeal and re-appeal this decision.
A pupil of the 8th grade of school number 162, Elina Hajiyeva, threw herself from the third floor of the school on 4 April. As a result of the fall, the teenager suffered serious injuries. However, an ambulance was called to her by the school administration only two hours later. Two days later, Hajiyeva died in hospital.
A criminal case was initiated under Art. 125 (Bringing to Suicide) of the Criminal Code.
Later, the school principal, Abbasova, was charged under Art. 143 (Leaving Someone in Danger) and 314.2 (Negligence Resulting in Someone"s Death) of the Criminal Code.
The family of the deceased demands the arrest of the school principal, believing that if she had called the doctors on time, the teenager could have been saved. -06d--
