Mamed Ibrahim Arrested for Two Months
Narimanov District Court of Baku on Saturday decided to arrest Advisor to the Chairman of the Popular Front Party of Azerbaijan (PFPA), Mamed Ibrahim for two months.
Ibrahim was arrested on September 30th by Narimanov District Police Office as a suspect under article 221.1 (hooliganism). On October 1, he was charged under the article providing for imprisonment for up to 1 year. On October 2 Narimanov District Police Office submitted to the court an idea of arresting Ibrahim in a preventive way. However, the court considered the question and did not announce a decision and moved the trial to 15:00 October 3rd.
On Saturday, about 16.00 Judge Mazahir Sadigov announced the decision to arrest Ibrahim for two months. The lawyer Yalcin Imanov said the decision of the court was unreasonable. According to him, under Article 221.1 of Azerbaijan no one is subjected to pre-trial detention. Because of this article, the maximum penalty is up to one year in prison.
The defense will submit an appeal against the court's decision.
Furthermore, the lawyer will submit a complaint against the arrest of Ibrahim without trial beyond the time prescribed by law. For example, the 48-hour period of detention of Ibrahim without a court order expired on October 2 about 23.30. But he was not released. Thus, he was kept more than 16 hours without a court order is illegal detention, the lawyer said.
Imanov said the intention of the defense to appeal to the Strasbourg court against the breach of Article 5 ("liberty and security of person") of the European Convention for Human Rights and Freedoms against Ibrahim.
The criminal liability of Ibrahim came from the complaint of Mikail Guliyev, who left the PFPA with a group led by the former deputy chairman of PFPA Razi Nurullayev some time ago. During the conflict between Ibrahim and Guliyev on September 29, the latter was torn his shirt.
The PFPA believes that against Ibrahim a provocation was committed in order to discredit the party, and the authorities use the group that left the PFPA for that. -06B--
