Mamed Ibrahim asks the court to reconsider his punishment
Baku / 29.01.18 / Turan: Adviser to the Chairman of the Popular Front Party Mamed Ibrahim appealed to the court to review his case in connection with changes in the criminal legislation, reported his son Turan Ibrahim.
Ibrahim was convicted under Article 221.2.2 (hooliganism with resistance to the police) for 3 years of imprisonment. At that time, the maximum sanction of the Article was 5 years imprisonment.
However, at the end of 2017, the Criminal Code was amended, and the upper limit of punishment for this article was reduced to 4 years. Taking into account the mitigation of the penalty under the charges, Ibrahim asked for a review of his punishment. The case will be examined in the Surakhani district court.
According to the lawyer Asabali Mustafayev, after amending the legislation, many convicts go to court to review their punishment.
The lawyer considers these appeals to be logical. These penalties accounted for a certain portion of the maximum term. Now, with a decrease in the maximum period, the term of the punishment that has already been imposed must be proportionally reduced.
Ibrahim was arrested on September 30, 2015 on the complaint of Mikayil Guliyev, a former member of the PFPA. Subsequently, the article was re-qualified for article 221.2.2 (hooliganism with the use of weapons).
The Narimanov court on March 15 found Ibrahim guilty and sentenced him to 3 years in prison.
In connection with the departure of 1/3 of the third and ½ of the term, Ibrahim has already applied to the court to mitigate the punishment and transfer him to a colony-settlement. However, these applications were rejected. Human rights organizations have recognized Ibrahim as a political prisoner. -06B -
