NIDA activists seek compensation for unjustified imprisonment
Baku/17.07.23/Turan: The Baku Court of Appeal has decided to pay a monetary compensation for moral damage to a former member of the NIDA movement, Mammad Azizov, his lawyer Fariz Namazli said.
According to him, after the decision of the European Court of Human Rights, which recognized the unlawful prosecution and arrest of Azizov, the Plenum of the Supreme Court of Azerbaijan in 2022 acquitted him.
"We appealed to the court and demanded compensation of 100 thousand manats. The Nasimi District Court also awarded compensation in the amount of 36 thousand manats. We did not agree with this and filed an appeal, because other persons in the same case were awarded compensation of 66 thousand manats," the lawyer said.
The Court of Appeal partially satisfied the complaint and as a result, Azizov was awarded compensation in the amount of 66,700 manats.
Earlier, the Nasimi court awarded compensation in the amount of 20 thousand manats to another NIDA member Shahin Novruzlu, who was convicted in the same case with Azizov and other activists. In addition, the court decided to return 94 thousand manats to Novruzl, which were confiscated at their home during detention, despite the fact that the funds belonged to his late father and were not related to the case.
However, the Ministry of Finance, as a defendant on the part of the state, filed an appeal and the case will be considered on July 18.
Azizov was sentenced in May 2014 by the Baku Court for Serious Crimes to 7.5 years in prison on charges of organizing mass riots, illegal trafficking of drugs and weapons. Novruzlu was then sentenced to 6 years in prison. In October 2014, he was pardoned.
Azizov was pardoned in 2016 . Subsequently, the ECHR recognized the violation of the rights of both activists. ---06B---
