The ECHR charged the government of Azerbaijan a fine of 146 thousand eurosSociety
Baku/21.03.19/Turan: The European Court of Human Rights (ECHR) upheld the complaint of Azerbaijani citizen Adalat Ahverdiyev against the government of the country. The decision on the case "Ahverdiyev against Azerbaijan" was announced on March 21, 2019 on the ECHR website.
The complaint was connected with the demolition of the house of Ahverdiyev. According to lawyer Fuad Agayev, who represented the interests of Ahverdiyev in the ECHR, Ahverdiyev had a house in the village of Khutor, Narimanov district of Baku. In 2009, his house was demolished. The owner was offered an apartment on the site of an old cemetery in the Narimanov district. Ahverdiyev refused the apartment. He complained to the court about the violation of property rights. However, neither the Narimanov District Court, nor the higher courts satisfied the complaint.
Ahverdiyev further applied to the ECHR.
In 2015, the ECHR recognized the violation of Ahverdiyev"s property rights. However, then the decision on the appointment of compensation was not made. Now the Strasbourg court has determined the specific amount of compensation for the demolished house in the amount of 140 thousand euros. In addition, the ECHR ordered the government of Azerbaijan to pay 3,000 euros each as compensation for moral damage and reimbursement of court costs. -06в--
