The ECHR refused to investigate the case of human rights defender Gulalyev
Baku/16.05.23/Turan: The European Court of Human Rights (ECHR) rejected a complaint about the violation of the rights of human rights defender Ogtay Gulalyev.
Composed of one judge Martin Mits the ECHR considered on April 13, 2023 the application submitted on February 20, 2023. The complaint concerned alleged violations of article 1, paragraph 2, article 3 and article 13 of the Convention. Having examined all relevant information, the Court concluded that the questions presented did not show any signs of violations of the rights or freedoms set forth in the Convention or its Protocols. Consequently, the complaints were found to be manifestly unfounded, as defined in article 35, paragraph 3 (a). Thus, the Court considered the complaint inadmissible, as indicated in the decision of Judge Mits.
The complaint filed with the ECHR was filed by the family of Ogtay Gulalyev, who for two years unsuccessfully sought justice within the legal system of Azerbaijan against medical workers, whose actions led to serious consequences for Gulalyev's health, bordering on death. He has been in a vegetative state for three years.
The Parliamentary Assembly of the Council of Europe (PACE) elected Martin Mitsa (Mârtiŋŝ Mits) as a judge of the European Court of Human Rights from Latvia on June 23, 2015 for a term of 9 years.-0--
