The Human Rights Center "Defender" assists the PFPA in filing a lawsuit against the Ministry of Justice
Baku/11.10.23/Turan: The Defender Legal Center ("Mudafiəçi") provided the Popular Front Party (PFPA) with advisory assistance when filing a lawsuit against the Ministry of Justice in connection with the refusal to enter the results of the last congress of this opposition party into the state register, the message of the Human Rights Center "Defender", received by the Turan agency.
On June 24, the Seventh Congress of the PFPA took place, at which the chairman of the party and members of the control and audit commission were elected, the new composition of the Supreme Mejlis was approved, and other decisions were made.
On June 28, the party appealed to the Main Department of Registration and Notary of the Ministry of Justice to enter the results of the congress in the state register. On September 1, the Ministry of Justice denied this. The decision was motivated by the fact that one of the members of the PFPA appealed to the Nasimi court with a claim for the recognition of the results of the congress as "invalid" and his application was granted.
This decision of the Ministry of Justice creates obstacles to the free and functional activities of the PFPA as a political organization.
On October 6, with the assistance of the Human Rights Center "Defender", the PFPA filed a lawsuit with the Administrative Court, asking the Ministry of Justice to include the results of the congress in the state register of legal entities.
On October 9, the lawsuit was accepted into production and submitted to Judge Selma Salakhova. The lawsuit states that the Ministry of Justice, when refusing, did not indicate any of the grounds specified in the legislation.
The court's satisfaction of the claim of one of the party members to recognize the results of the congress as invalid does not create a legal basis for refusing to submit the party's documents to the state register.
The decision of the Ministry of Justice contradicts Articles 58 (right to association) of the Constitution of Azerbaijan and Article 11 (freedom of assembly and association) of the European Convention on Human Rights and Freedoms and Article 18 (Limits on the use of restrictions on rights) of the European Convention on Human Rights and Freedoms and the laws on political parties and on the State Register of Legal entities.
