Baku/14.10.22/Turan: Turan continues to cover an interesting  trial in the Baku Serious Crimes Court, where a lawsuit filed by businessman Afgan Zeynalov against Nelly Fabrichnaya, the head of the HR department of “Murov” TSK LLC, is being considered. The company performs construction contracts for CJSC “Dəmiryol.” Previously, the same Zeynalov owned another company that worked with the Agency for Highways. As a result of cooperation with road workers, Zeynalov was previously convicted by the Lankaran Court for serious crimes. This did not prevent him from getting a contract from the railroad.

Fabrichnaya considers herself completely innocent, rejects all accusations that she allegedly appropriated 720,000 manats  of unknown  origin allegedly belonging to Zeynalov. There is no evidence that Zeynalov really had this amount and whether it was actually in his office safe, which turned out to be in a private apartment.

The trial is led by Judge Faik Ganiyev. Witnesses for the prosecution were heard on Thursday. Taxi driver Ibadat Jafarov said that he gave a ride to “Murov” employee Mehriban Atakishiyeva, then she talked  to Fabrychnaya in the car for half an hour. The driver was out of the car at that time and did not know what they were talking about. He does not remember the date of the episode.

Nelly's father, Vyacheslav, came to court. The testimonies of V.Fabrichny, the former CJSC “Dəmiryol”,  were full of important details. He said that he had known Zeynalov for about 6-7 years. There were normal trusting relationship between them. Zeynalov  gave a job to his daughter, Nelly, in his company, and also financed the trips of the Fabrichnys’ spouses to Dubai and Belarus. Vyacheslav took care of Afgan Zeynalov  when he was seriously ill and was unconscious.

One day, Afgan Zeynalov asked Vyacheslav to place a metal safe in his three-room apartment in Baku, because he, as the owner of a company building railway facilities, lives in a rented apartment in Baku, and is afraid to keep money in his rural area. Vyacheslav agreed because he believed Zeynalov, in whose company his daughter Nelly worked. The safe was installed, on the same day Zeynalov came to them with a black suitcase, secluded himself in a room with a safe, then left without giving the owner of the apartment the key and code to the safe. He put money in the safe, or something else, or did not put anything, Vyacheslav does not know.

 

 

Vyacheslav granted Zeynalov's second request and registered him in his apartment. A few months later, a scandal erupted when Zeynalov announced the loss of 300,000 manats from the safe. Then this amount increased to 720,000 manats.

When the proceedings were going on, Vyacheslav was shown a receipt for money, written by Nelly, but he did not recognize his daughter's handwriting. He believes that the receipt was not written by Nelli Fabrichnaya. Vyacheslav refuted Zeynalov's testimony that he had witnessed Zeynalov's transfer of money to his daughter, Nelly Factory.

To the questions of the prosecution's lawyer, Irada Javadova, the witness said that he had no information that Nelli had given out to third parties the amounts from Zeynalov's notorious money. Vyacheslav did not see  that Nelly took something from this safe. A. Zeynalov claimed that Nelly took money from him in the presence of her father.

According to Vyacheslav, Afgan Zeynalov offered him, in the presence of the police, to give him 60 thousand dollars, allegedly from stolen money. The court then listened to the testimony of Mehriban Atakishiyeva, a cleaner who worked for the company. She claims that she received AZN 50,000 from Nelli Fabrichnaya and bought her son a Mercedes minibus.

The investigation considered that this money belonged to Zeynalov. Then Atakishiyeva returned 70,000 (there are also testimonies about 75,000) manats to Zeynalov.

There are no witnesses to the receipt of money from Nelly, Atakishiyeva answered the lawyer's question. Atakishiyeva rejected A. Zeynalov's statement that she was ready to give him a receipt for the return of the money.

The day ended with a protest by Fabrichnaya's lawyer, Gazanfar Rzayev, who remarked to Judge Ganiev that he was wrong, saying that at the last hearing, M.Atakishiyeva allegedly said that she had promised, together with N.Fabrichnaya, to return a large sum to the victim recognized by the investigation.
