Residents of an Elite Building Against Xətai Park Servis Management Company
Police officers from the 36th Department of the Khatai District Police Department have detained Saday Sarkarov, who was elected by residents of the residential complex at 58b Ganja Avenue to represent their interests in court against the management company Xətai Park Servis.
According to lawyer Akram Hasanov, who spoke to Turan, police are not allowing legal representation for Sarkarov. Hasanov believes that Sarkarov was detained in order to pressure him into withdrawing from the legal case on behalf of the residents.
Apartment owners in the residential complex claim that Xətai Park Servis LLC unlawfully took control of the complex’s management by falsifying a document that allegedly shows the residents’ approval of a contract with the company.
A representative of Xətai Park Servis asserts that on May 1, 2020, the residents convened and collectively decided to hire the company for management services. However, the lawyer representing the residents argues that at that time, the country was under quarantine, and gatherings of more than ten people were prohibited. The residents of the complex seek to terminate what they believe is an illegal agreement with the company.
To resolve the dispute legally, the residents appointed Saday Sarkarov, an apartment owner in the building, to represent them in court against the company. His lawyer in the case, Akram Hasanov, informed Turan about the ongoing conflict.
"There have been two hearings at the Khatai Court, and it is clear that Xətai Park Servis is operating illegally. The court’s ruling will obviously be against the company. That is why a representative of Xətai Park Servis repeatedly threatened Sarkarov inside the courtroom. Why did the police detain the respectable Sarkarov but fail to take action against the unlawful actions of Xətai Park Servis? Why is no one questioning how this company allegedly held a general meeting during quarantine?" – Hasanov protested.
In a phone conversation with Turan, Ali Mammadov, an assistant superintendent of the residential complex, stated that not all residents oppose Xətai Park Servis, but rather only Sarkarov and a few others. He explained that during the pandemic, a different form of general meeting took place: 970 apartment owners – all employees of the Presidential Administration – signed an agreement to hire Xətai Park Servis for management. Since 970 is more than half of the total 1,530 apartment owners, the decision is legally valid, Mammadov asserted.
"We do not know why the police detained Sarkarov. This detention has nothing to do with Xətai Park Servis," Mammadov added.
