Activist of Musavat remains in custody without trial
Baku/26.10.13/Turan : Advisor to the Chairman of the party Musavat Yadigar Sadiqov is detained illegally . According to the lawyer Khalid Bagirov, Sadygov's arrest term expired on October 22 , but he continues to be detained under the pretext that the case has been referred to the court for consideration on the merits.
Sadiqov filed a complaint with the Sabunchu District Court of Baku in connection with his unlawful detention.
According to the lawyer, the investigation refers to the abstract norm of Article 158 of the Criminal Procedure Code and states that after the case was referred to the Court there is no need to extend the period of detention.
However, as stressed Bagirov , there are precedents of the European Court of Human Rights , according to which a person can not be detained without a court order.
Moreover, in 2011 the Constitutional Court of Azerbaijan on the basis of application from the Shirvan Court of Appeal recognized the specified provision of Article 158.3 of the Criminal Procedure Code unconstitutional.
However, the Sabunchu Court dismissed the complaint from Sadygov. This decision will be appealed to the Court of Appeal.
Recall that Yadigar Sadigov was arrested June 27 on charges of disorderly conduct on the complaint of a resident of Lankaran Rashid Karimov. In this case, the complaint by Kerimov about Sadygov before police custody was replicated in the pro-government media.
Member of the opposition called it a provocation and an extended far-fetched and politically motivated accusation.
A number of local and international human rights organizations believe Sadygov a political prisoner. -06D- -

According to a report by Turan correspondent, the discussions took place behind closed doors and lasted for over an hour. No statements were made to the press following the meeting. Furthermore, conference security prevented journalists from asking questions to the meeting participants.
