Ali Insanov complains to the Council of Europe against Azerbaijan"s Supreme Court
The convicted ex-Minister of Health Ali Insanov filed a lawsuit against Ramiz Rzayev, the head of the Supreme Court and Plenipotentiary of Azerbaijan to the European Court of Human Rights (ECHR) Chingiz Askerov.
Insanov’s complaint is related to the non-fulfillment of such persons by the ECHR , which came into force on 14 June, 2013 on non-recognition the verdicts of the Azerbaijani courts in the case of Insanov.
According to the lawyer Togrul Babayev, the claim was accepted by the Administrative and Economic Court N 1.
However, on September 3, the lawyer received an official letter from the Supreme Court of Azerbaijan, that this body did not receive any document on coming into force of the decision of the Strasbourg Court .
The Supreme Court says that as soon as the decision by the ECHR and its official translation in the Azerbaijani language is received by the Supreme Court, the case of Insanov will be considered. However, according to the lawyer, the ECHR decision was presented to the Supreme Court on July 10 , as well as the authorized ambassador of Azerbaijan to the ECHR.
The lawyer believes that the Supreme Court strongly deviates from passing the ECHR's decision to the Plenum of the Supreme Court, which should adopt the decision on annulment
The verdict against Insanov, and he should be released. Therefore Insanov decided to send to the CE Committee of Ministers non- formal appeal on not fulfilling the ECHR’s decision.
On March 14, 2013 the European Court of Human Rights, granted the Insanov’s claim on the right to a fair trial, and confirmed the fact of torture.
For this reason, the European Court ruled that the government of Azerbaijan should pay Insanov a compensation of 10 thousand euros.
Insanov was arrested in October 2005, and charged with preparing a coup, but later the charge was changed, and he was sentenced to 11 years for economic crimes.—06B-
