Court did not release Arif Hajily's son under house arrest
Baku/22.11.23/Turan: On Wednesday, the Yasamal court of Baku rejected a request to transfer the son of the head of the "Musavat" Party Arif Hajily – Orhan Hajily under house arrest.
As lawyer Nemat Kerimli told Turan, there are no grounds for keeping O. Hajily in custody. He is charged under Article 263.1 (violation of the rules of road traffic, which caused less serious damage to the victim's health) and 264 (escape from the scene) of the Criminal Code of Azerbaijan.
These Articles belong to the category that do not pose a great public danger and the maximum penalty for them is up to 2 years of imprisonment.
According to the legislation, under these Articles, pre-trial detention is possible only in exceptional cases if the accused is hiding from the investigation.
However, Orhan did not evade the investigation and appeared to the police on the first call.
"The accident was not his fault, he did not run from the scene of the accident. After the accident, there were no victims at the accident site. He was "found" after 20 days," the lawyer said.
*On November 2, the Yasamal court of Baku arrested Orhan Hajily for 2 months. According to Articles 263.1 (violation of traffic rules that caused less serious harm to health) and Article 264 (leaving the scene of a traffic accident) of the Criminal Code of Azerbaijan.
Recall that the accident occurred on October 11. O. Hajily himself called the case as political and connected it with the opposition activities of his father. The "Musavat" Party announced the political motives for the persecution of O. Hajily. - 21B16/06-
