Baku/29.12.22/Turan: On 28 December the Court of Appeal presided over by Habil Mammadov changed the verdict of the court of first instance in the case of former head of the Transport and Energy Security Department Akif Chovdarov and his employee Salim Mammadov. According to the decision, these individuals will be returned multi-million dollar real estate, which the court of first instance confiscated as illegally obtained.

The Court of Appeal refused to disclose the details of the decision to the Turan agency as saying that "the management does not permit this. This information is only provided to the parties to the case and their lawyers, the court office said.

In turn, the press service of the Prosecutor-General's Office said it had no information whether an appeal would be filed against the ruling.

It ought to be reminded that the question is about the property amounting to 33 million manats, which includes a shopping centre, mansions, land plots, flats, non-residential premises in Baku, Absheron and in the regions of the country.

Without reviewing the decision of the Court of Appeal, it is difficult to say whether the information about the return to the convicted Chovdarov of all this multi-million dollar property is correct.

However, even if it is a small portion of these 50 properties, this contradicts the allegations that Chovdarov was involved in racketeering, kidnapping businessmen to enrich himself.

Recall that in 2015, the Prosecutor-General's Office opened a criminal case against more than 20 officers of the Ministry of National Security (liquidated in the same year).

It was about mass abuses, abuse of power by high-ranking officials of the MNS. In 2017, the illegally obtained property of MNS officers worth 56 million manats was seized.

Akif Chovdarov and Salim Mammadov were arrested in 2015 on charges of
grand larceny by an organised group, robbery by an organised group to seize property on a large scale, extortion to seize property, illegal possession of weapons, violation of legislation on operative-search activities to obtain information by secret means, bribery on a large scale by an organised group, document forgery and other articles of the Azerbaijan Criminal Code.

Akif Chovdarov was sentenced to 12 years of imprisonment with confiscation of property, Salim Mammadov was sentenced to 11 years of imprtisonment.

Note that Akif Chovdarov was released on a presidential pardon in 2020, while Salim Mammadov was released also on a pardon in 2022.

In December 2021, the Supreme Court decided to refer Chovdarov's complaint about his confiscated property to the Court of Appeal for review.-03-
