Strasbourg court : extradition of I.Musayeva is impossible
Baku/13.09.13/Turan : The European Court of Human Rights ( ECHR) has notified the Russian authorities about the impossibility of extradition to Azerbaijan Ibrahim Musayev, a citizen of this country, an employee of the Ministry of National Security of the Nakhchivan Autonomous Republic (NAR) until given notice, according to the Russian on-line edition "Caucasian Knot".
The decision to extradite Musayev was announced on September 2 in the Yaroslavl Regional Court. The Court upheld the decision of the Russian General Prosecutor Office on extradition Musayev to Azerbaijan. The lawyer Dmitry Sukhomlinov filed a complaint against this decision to the Supreme Court of Russia. Earlier, on August 28, Musayev applied to the ECHR." On September 11, 2013 Chairman of the Section to which the case was sent, taking into account the interests of the parties and the proper conduct of the proceedings in the court, to indicate to the Government of the Russian Federation, that in accordance with paragraph 39 of the Rules of Court, the applicant should not be deported to Azerbaijan without notice," reads the letter of the Strasbourg Court on September 12 sent to Olga Sadovskaya, the Deputy Chairman of the Committee against Torture, representing the interests of Musayev the interests of the European Court, and Chingiz Askerov, a representative of the Azerbaijani government under the ECHR.
The ECHR also noted that in the interests of the proper conduct of the proceedings, the government of Azerbaijan should submit before October 3 the information about Musayev: to clarify whether he was a member of National Security Ministry of Nakhchivan, or collaborated with the service in a different form?
The Court also suggested that the Government of Azerbaijan presented copies of the lawsuit against Musayev, testimonies of witnesses, and complaints against him.
The Russian government offered to provide the court a copy of the request for extradition and all documents related to this request , in particular, the materials of the lawsuit against the applicant.
A lawsuit was filed against in Azerbaijan against Musayev on fraud. Ibrahim Musayev himself told that he was unreasonably put on the international wanted list in Azerbaijan.
Musayev stated that the authorities of Nakhchivan are engaged in supplying weapons and products for Kurdish terrorists in Turkey. He also said that he was ordered to kill Turaj Zeynalov's wife, who was arrested on suspicion of spying for Iran and died of tortures in the Ministry of National Security of NAR.
After refusing to commit a crime , Musayev fled from Azerbaijan, and was arrested in Russia at the request of the Azerbaijan.-06D-
