Baku/06.10.23/Turan: On October 5, the European Court of Human Rights (ECHR) announced a number of new decisions on statements against Azerbaijan.

The case "Rashad Hasanov and Others against Azerbaijan", which combined the complaints of former activists of the Nida movement Rashad Hasanov, Uzeyir Mammadli, Rashadat Akhundov and Zaur Gurbanli for criminal prosecution on charges of illegal arms trafficking, organizing mass riots, was excluded from the list of pending cases.

According to the website monitoring the decisions of the ECHR Aihmaz.org the reason for this was the recognition by the government of violations of the rights of these persons, their rehabilitation by the decision of the Supreme Court and the payment of compensation to them.

At the same time, the ECHR decided to pay compensation to the lawyers and representatives of the applicants for reimbursement of court costs by 5 thousand euros.

In the case "Jalal Huseynov and Others v. Azerbaijan", convicted on various charges Jalal Huseynov, Zaur Ganbarov and Natig Mammadsoy complained of inhumane treatment, and in particular their detention in court in an iron cage. In this case, the Government and the applicants reached a settlement agreement.

The authorities agreed to pay them compensation in the amount of 1,700 euros each and 600 euros for reimbursement of court costs.

In the case of Agaguseyn Gezyalov v. Azerbaijan, the applicant complained about the violation of his rights during the 2015 parliamentary elections. After the applicant's death, his son continued the complaint. In this case, the parties also reached a settlement agreement.

The Government has pledged to pay the applicant's successor 3,000 euros and another 500 euros for court costs.

The applicants in the case "Gazaryan and Bayramyan v. Azerbaijan" were Armenian citizens Armen Ghazaryan and Astgik Bayramyan, who live in the village of Berdavan, located a few kilometers from the border of Armenia with Azerbaijan.

Their 39-year-old son Karen Ghazaryan, who has mental health problems, was detained by the Azerbaijani military in July 2018 and sentenced to 20 years in prison on charges of sabotage. In December 2020, he was returned to Armenia as part of a prisoner exchange.

The ECHR recognized in this case a violation of Articles 3 (prohibition of torture), 5 (right to freedom and personal integrity) of the European Convention and decided to pay Karen Kazaryan 10,000 euros for moral damage and 3,225 euros for legal costs, according to a statement published on the ECHR website.

At the same time, the ECHR declared inadmissible complaints in two cases from Armenia "Garik Ohanyan and Others against Azerbaijan" and "Manvel Hakobyan against Azerbaijan", in which the applicants reported being forced to leave their homes during the 2016 military operations.

The ECHR also announced decisions on 4 cases of a group of Azerbaijani citizens against Armenia. In one case, the ECHR found no violations, and declared three statements inadmissible. ---06B---
