The Grand Chamber of the ECHR will announce the decision on the case of I. Mamedov on May 29
Baku / 23.05.19 / Turan: On May 29, the Grand Chamber of the European Court of Human Rights will decide on the case of the leader of the REAL party Ilgar Mamedov.
The trial was conducted in order to establish a violation of Article 46 § 4 "in the case of Ilgar Mamedov v. Azerbaijan," the report said on the ECHR website.
The talk is about the non-execution by the authorities of Azerbaijan of the decision of the ECHR of May 22, 2014 on the illegality of the conclusion of Mamedov in connection with the Ismayilli events of 2013.
The court found that there was no reasonable suspicion that Mamedov committed the crime. The ECtHR considered that the real purpose of bringing a criminal charge against him was to silence or punish him for criticizing the government.
The Committee of Ministers considered the case for the first time in December 2014 and called for the immediate release of Mamedov.
Subsequently, the committee repeated this appeal, but the authorities stubbornly refused to release Mamedov.
In October 2017, the CE Committee of Ministers officially notified Azerbaijan that it had not fulfilled its obligations under the Convention to comply with the 2014 decision of the ECHR.
In this regard, for the first time in the history of the Council of Europe, in accordance with Article 46 of the European Convention, a procedure was launched to establish that a member state does not fulfill its obligations to the organization.
The appeal of the Committee of Ministers was submitted for investigation to the secretariat of the ECHR on December 11, 2017, and then it was submitted to the Grand Chamber of the Strasbourg Court.
* Ilgar Mamedov was arrested in February 2013 in connection with the riots in Ismayilli and sentenced to 7 years in prison. In August 2018, the Sheki Court of Appeal released him, replacing the remaining term with a suspended sentence, with a 2-year probationary period. -06D-
