Abutalibov will be brought to justice to the Court of Appeal
Baku Administrative Economic Court N 1 has partially satisfied the claim of the Turan News Agency against the Baku Mayor Office at the request of information on the newsstands installed in Baku. The court ordered the agency to provide the information on the owner of the newsstands and their number, and pay 10 manat of court costs.
The judge Vusala Bahysheva did not grant the petition of the agency asking to fine the defendant from 50 to 100 manat (Article 57.1 of the Administrative Procedure Code) for not participating in the court trial, and the failure to provide the requested information. She also did not grant a petition to urge the Mayor Office give a complete answer to the request of the agency.
The Court could not obtain from the defendant an official decision on the replacement of the kiosks belonging to company GASID; on the non-profile use of stalls; on the damage caused to the editorial offices by the Executive Power and sabotaging by the city authorities the Presidential order on state support for media.
The judge Bahysheva considered that the court completed proceedings, and closed the case.
The Agency intends to appeal the judgment in the Court of Appeal.
It was a third trial after the inquiry on the Mayor of Baku, Abutalibov of 28 August last year. The suit was filed in accordance with Article 24.1 of the law "On freedom of access to information."
During five months the agency failed to get the required information and conduct an investigation, which is able to shed light on the situation with the stalls.
As is known, the monitoring conducted by journalists showed that kiosks are practically an extensive network of illegal trade in food and is aimed at containing the growth in sales of the print media, especially the independent press.
Director of Turan news agency, Mehman Aliyev, believes that the court deliberately delayed the proceedings and supported the interest of the Mayor Office trying to justify the refusal by the fact that issues are of public significance.—0—
