"Azerpocht" "lost" the complaint to the ECHR
Baku/26.11.18/Turan: The complaint of the head of the Majlis of the Republican Alternative Party (REAL), Azer Gasymly, to the European Court of Human Rights for his administrative arrest in May of this year did not reach the addressee.
Gasimly was arrested for 30 days on charges of not submitting to the police. It happened the day after the festive procession organized by REAL on May 28 on the occasion of the 100th anniversary of the People"s Republic of Azerbaijan.
According to Gasimly, in July his lawyer sent a statement to the ECHR through Azerpocht (state postal enterprise).
"However, as the lawyer told me, the letter has disappeared," Gasimly told Turan.
According to him, the deadline for submitting an application to the ECHR is 6 months from the date of the last court decision. This term has not expired, and the application will be sent by alternative mail.
It was not possible to get comments at Azerpocht LLC. Earlier, lawyers Nemat Kerimli, Asabali Mustafayev, Elchin Sadigov also stated about the "loss" of complaints sent to the ECHR by youth activist Bayram Mammadov, deputy chairman of the Popular Front Party Fuad Gahramanly of the journalist of the Azadlig newspaper Seymur Hazi. They were subsequently re-shipped.
Earlier, Azerpocht recognized the loss of letters, urging not to make a sensation out of it. However, a number of lawyers believe that the letters disappear not for technical reasons, this is the result of the authorities not wanting the complaints to reach the ECHR.
Meanwhile, according to Gasimly, on December 13, the ECHR will announce decision on its complaint against the ban imposed on August 16 from leaving the country. -06D-
