Doubtful trial: The accuser's sister introduced new detective notes about kidnapping into the trial

Baku/01.10.22/Turan:   On Monday, the Baku Serious Crimes Court continued consideration of the lawsuit filed by businessman Afgan Zeynalov against Nelli Fabrichnaya, head of the personnel department of Murov TSK LLC, his company. The essence of the lawsuit is that Zeynalov accuses Fabrichnaya of stealing 720,000 manats, which he, as he stated in court, found in a garbage dump. And he kept this money in a personal safe located in the apartment of Nelly's father. Nelly denies all allegations. The trial is led by Judge Faik Ganiyev.

On October 31, the day was set aside for hearing the testimony of a witness for the prosecution, Zeynalov's sister, who convinced the judge that Fabrichnaya deliberately and secretly poisoned her boss. Zeynalova Hokume in a long and confused speech often talked about Allah and his mission to protect honest people, her employment in the kitchen, because of which she could not know what she was asked in court, her brother’s consciousness at the level of a three-year-old child, a great contribution  of Afghan Zeynalov in the liberation of Karabakh and the evil intent by Nelly Fabrichnaya, whom Zeynalova immensely trusted. The speech was interrupted by shouts from her accuser brother's seat, for which the judge lifted Afgan Zeynalov from his seat and warned him of inappropriate behavior. The warning was also received by Fabrichnaya's lawyer Gazanfar Rzayev and defendant Nelly Fabrichnaya.

Before listening to H. Zeynalova, the judge informed her of the right not to speak to the detriment of her brother's interests. In that case, what is her testimony worth? But in the Zeynalov family there are four brothers, one sister and nephews, whom the judge intends to listen to.

Part of H. Zeynalova's testimony related to the period of her brother's serious illness, when Nelli Factory was engaged in the purchase of medicines according to doctors' prescriptions and helped Afgan to take medicines. H. Zeynalova claims that after these medicines her brother became ill, but at the same time she did not prevent Nelly from continuing to participate in the treatment of the patient. She does not know the names of medicines, she remembers valerian, night cramps in her brother, whom Allah saved after the prayer of a weeping sister. Then Hokume Zeynalova told how she begged Nelly not to kill her brother and offered her 10 thousand manats for this, which she promised to collect from the Kalbajar.

The Zeynalov family, former refugees from this region, live in the Goranboy region. It should be noted here that due to the acoustic features of the hall in the Court for Serious Crimes, not all of what was said is heard at the end of the hall, where seats are reserved for spectators and journalists. Therefore, there may be minor errors in our report.

According to H.Zeynalova, Nelli stated that she had taken “400-500 thousand manats” from Afgan Zeynalov and claimed that she “did the right thing”. At first, the witness spoke about 4-5 thousand manats, but after a leading question from the judge, she forwarded the testimony for 400-500 thousand manats. According to the witness, Nelly promised to return the money taken by selling apartments in Baku and Moscow.

Zeynalova also claims that Nelly threatened to kill Afgan Zeynalov and explained to Hokume that she had to do this, because otherwise Nelly would be killed. Who intended to kill Nelly - H. Zeynalova does not know.

After a question from lawyer Rzayev, it turned out that there was no witness in any of the episodes listed by the witness. Everything that was said came from the  accuser's sister, no one can confirm this.

When it came time to ask questions to the witness for the prosecution, the judge did not allow lawyer G. Rzayev to ask about the acquisitions of Afgan Zeynalov, who, according to the lawyer, bought an apartment and a car for his son. The discussions also included the purchase of a road tractor. It is interesting that, interrupting the lawyer, Judge Faik Ganiev explained that the lawyer intended, having received an answer, to link the loss of money with the large acquisitions of Afgan Zeynalov. It is not clear why the judge is against the development of this version in court, because if A. Zeynalov spends large sums for personal needs, then he takes them somewhere.

H. Zeynalova, who claimed that “Nelli Fabrichnaya gave financial documents to Afgan Zeynalov, who was in the condition of a three-year-old child, for signature,” could not answer Nelli Fabrichnaya's question about the amounts of money indicated in the reports that her brother signed during his illness. And what was written in those documents H. Zeynalova does not know, as she cooked in the kitchen.

During the testimony, she suddenly remembered with joy that she had warned her brother Mamed, the attackers were employees of Murov TSK LLC. Mehriban and Rauf can steal Afgan Zeynalov's son to extort money from him.

H. Zeynalova argued in court that the father of the accused, Vyacheslav, knew about the theft of Afgan Zeynalov's money by his daughter and said that he was refusing such a daughter, even offered to subject Nelli to torture with electricity in order to knock Afgan's money out of her. In a conversation with  Turan correspondent,  Vyacheslav Fabrichny rejected these strange, as he said, testimony of the witness.

With such reminiscences from the accuser's sister, the trial at Murov could rise to the status of the trial of the century. But the next step is hearing the testimony of the four brothers of Afgan Zeynalov and even the children of the brothers. Each time the judge will pay attention to the family ties of the witnesses with the main accuser, their right not to testify against their brother. But against Nellie Factory, they can say whatever they want. What is the value of the words of such witnesses?
