Journalist and His Lawyer Cannot Get Court Protocol
For more than a week the correspondent of radio Voice of America Tapdig Farhadoglu together with his lawyer cannot get acquainted with the solution of the Yasamal District Court at the suit of the journalist.
The complaint was filed in court in connection with the refusal of the investigator Mubariz Asadov to open a criminal case on the fact of physical violence against the journalist. The incident took place during his report from the protest of BSU students on February 20.
The Judge Azer Tagiyev in the Yasamal Court rejected the claim, but the protocol has not been issued. The representative of the journalist Samir Agayev reported that for the fifth time he visited the Yasamal court to get the protocol. "I cannot read the protocol. The reasons are different.
On December 16 the Secretary of the Judge Azer Tagiyev said that to get acquainted with the protocol an application is needed. However, there is no law of the sort. According to Article 51.7 of the Criminal Proceedings Code, a person has the legal right to familiarize with the protocol within three days. The law does not provide for writing statements in this regard," said Agayev.
Tapdig Farhadoglu and his representative do not agree with the decision of the court and are going to file a complaint.
Recall that the February 20, 2014 the Head of BSU Security Service Mahir Hojjatov hit the journalist with his fist and kicked him in the back and on the head, when Tapdig Farhadoglu was filming a protest of the students. As a result, the journalist got partially unable to function.
The video shows how Mair Hojjatov beats the journalist. In fact, it is a crime under Article 163 of the Criminal Code (interference with the lawful activities of a journalist).
"Despite the existence of video evidence, the court dismissed the complaint. I will complain to the European Court," said Tapdig Farhadoglu.
In addition, the journalist appealed to President Ilham Aliyev, the Attorney General, and the Joint Working Group on Human Rights for objective investigation of the attack on him. -04B-
