Khadija Ismayilova require compensation from the prosecutor`s office
Investigative journalist Khadija Ismayilova has filed a lawsuit against the Baku City Prosecutor's Office, demanding compensation for unjustified detention for three months on charges of incitement to suicide. As a third party the Ministry of Finance was involved for the case. The preparatory hearing on the lawsuit will be held on August 17 in the Sabail District Court of Baku, chaired by Judge Azer Tagiyev.
Ismayilova was arrested on 5 December, 2014 and charged under Article 125 of the Criminal Code. Until 6 March, 2015 she was detained under this Article. However, on 1 September, 2015 the Baku Serious Crimes Court Ismayilova was sentenced to 8.5 years in prison for economic crimes, justified under Article 125.
Thus, the Court confirmed that from December 5, 2014 to March 6, 2015, i.e. 91 days Ismayilova was detained illegally.
Ismayilova demanded reimbursement for legal aid, lost profits due to the inability to work, and other expenses incurred in the period of arrest, as well as compensation for moral damage. Ismayilova assessed the total size of the material damage 9.030 AZN. For moral damages the journalist requires 20.000 manats.
On May 25 the Supreme Court of Azerbaijan removed from the journalist accusations of misappropriation and abuse of office, and replaced the real term of imprisonment of 3.5 years of conditional punishment.-06D--
